STEERS MONSTER COMPETITION RULES 

 

  1. This Promotional Competition (“Competition”) is organized by Coca-Cola Beverages South Africa (Pty) Ltd franchise bottlers of The Coca-Cola Company, Monster Energy and Steers and/or their designated agencies (collectively the ‘’Promoters’’).
  1. The Promotional Competition is open to permanent residents and citizens of South Africa over the age of 18 years in possession of a valid South African Identity Document. Any person who is under the age of 18 years (“a minor”), must obtain their parent or legal guardian’s consent, in order to enter and qualify for the Promotional Competitions. The Promotional Competition is not open to an employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their advertising agencies, advisers, dealers, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to The Coca-Cola Company, its affiliates and/or associated companies (“Disqualified Persons”).
  1. By entering the Promotional Competition, all participants and winners agree to be bound by these rules, which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotional Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
  1. The Promotional Competition commences on 27 November 2017 and ends on 20 February 2018, both days inclusive.
  1. Participants stand a chance to win 1 (one) of 10 (ten) Xbox One S (“Prize”). One Prize per participating Steers restaurant.
  1. To stand a chance of winning 1 (one) of the Prizes, participants must purchase any Monster Energy Drink (“Participating Product”) from any participating Steers restaurant. Participants must then write their name and cellphone number on the back of their till slip and drop it into the entry box in restaurant (“entry”).
  1. The Promoters will conduct a random draw from all the entries received to determine possible winners on 01 March 2018 (“Draw Date”). In order for a particular entry to be confirmed as valid, the Promoters will call the possible winners and ensure that the qualifying criteria set out in paragraphs 2 and 6 above are met (“the verification process”).
  1. Participants, whose entries have been drawn and have been confirmed as valid after the verification process, will be notified telephonically within 1 (one) week from the Draw Date and declared a winner and then provided with the details on how to claim their prize.
  1. In the event that a winning entry belongs to a minor, their parent or legal guardian must accept and/or be present in order to claim their prize.
  1. Participants may enter this Promotional Competition as many times as they wish provided they purchase the Participating Product and follow the entry mechanic set out in paragraph 6 above each time. However, participants are only eligible for 1 (one) Prize under this Promotional Competition and only 1 (one) winner per household is entitled to win a Prize.
  1. Participants may not enter this Promotional Competition or qualify to be a winner if they have won a competition promoted by Promoter within the past 6 (six) months.
  1. Entries that are unclear, illegible, are submitted via an incorrect entry mechanism, or contain errors, or are from Disqualified Persons will be declared invalid.
  1. If the Promoter is unable to reach a winner after 1 (one) week from the date of being declared a winner, or if a winner is a minor who did not obtain their parent or legal guardian’s consent, or if a winner fails the verification process after drawing his/her entry for whatsoever reason, such person will be disqualified and the draw of a replacement entry shall take place.
  1. The Prizes are neither transferable nor redeemable for cash and the Promoter is not liable for any defect in the Prizes. The Promoters reserve the right to substitute Prizes with any other prize of comparable commercial value.
  1. Should any dispute arise in relation to the interpretation of these competition rules, the Promoter’s decision shall be final and no correspondence shall be entered into.
  1. All participants and the winners, as the case may be, indemnify The Coca-Cola Company, the Promoter, their advertising agencies, advisers, nominated agents, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to The Coca-Cola Company, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation, in any way howsoever, in this Promotional Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Prizes).
  1. The Promoter may require the winners to complete and submit an information disclosure agreement and an indemnification form to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prize and it shall revert back to the Promoters.
  1. The Promoter may require the winners to be identified, photographed and the photographs published in printed media, or to appear on radio and television, when accepting their Prize and/or after having received their Prize. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Promotional Competition.

Terms of use 

The Steers software application (the “App”) is available for download from various app restaurants on compatible electronic devices.
The App enables users to order and purchase food and beverages from any of the participating Steers restaurants. As an alternative to placing an order via the App, orders can also be placed online via www.steers.co.za (the “Site).
These terms and conditions (“Terms and Conditions”) govern the ordering, sale, delivery and collection of Food, and the use of the App, online ordering and Telephone Service.
These Terms and Conditions are binding and enforceable against every person that accesses or uses the App, the Site or Telephone Service, including without limitation each user who registers as contemplated below By using the App, the Site or Telephone Service, you acknowledge that you have read and agree to be bound by these Terms and Conditions. You must not use the App, the Site or Telephone Service if you do not agree to the Terms and Conditions.
These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act 2008.

These Terms and Conditions contain provisions that appear in similar text and style to this clause and which –

  • may limit the risk or liability of Steers or a third party; and/or
  • may create risk or liability for the user; and/or
  • may compel the user to indemnify Steers or a third party; and/or
  • serve as an acknowledgement, by the user, of a fact.

Products and Promotions

  • Certain products or promotions are only redeemable at participating Steers restaurants in South Africa.
  • Steers reserve the right to amend or stop a promotion at any time.
  • Certain offers are limited to one per customer or have a minimum order applied, per participating restaurant, within the specified period.
  • Portion weights are raw weights.
  • All visuals are suggested servings only.

Delivery

  • Each restaurant has a designated delivery area that is indicated on the Site for each particular restaurant in relation to where an order is placed. Only deliveries within the designated delivery area of 3km from the restaurant are accepted. If the delivery area is not specifically mentioned on the Site in relation to the particular restaurant that the order is placed, such area is deemed not to be included in the designated delivery area for that particular restaurant. Steers reserves the right not to delivery any goods to an area outside of the designated delivery area. However, Steers may, at its sole discretion, elect to deliver goods to area outside of the designated delivery area, subject to a reasonable delivery fee. In order to calculate the distance from the restaurant to the user for the purposes of determining whether delivery applies will be calculated as the ‘as the crow flies’ distance calculated from the restaurant ordered from, to the first point of entry (i.e. security gate). The calculation for determining the delivery will be based on the actual kilometres travelled ‘door to door’.
  • Steers strives for the highest quality and therefore certain menu items might not be available for delivery, this includes ice cream cones & the Wacky Wednesday offer.
  • Orders of 10 (ten) or more meals, whether they are ordered by a single user or multiple users acting in conjunction with one another, may be excluded from delivery or certain of the delivery Terms & Conditions might not apply.
  • Delivery times may be affected due to bad weather, traffic conditions and/or any other unforeseen circumstances.
  • We will be standardising our delivery terms and conditions across all our restaurants nationally from 1 February 2018. Steers will have a minimum order value of R65 and charge a R15 delivery fee on all deliveries.

Delivery Cost & Payments

  • All extras will be charged for.
  • All prices shown are inclusive of VAT at the standard rate.
  • Prices are subject to change without prior notice.
  • The payment choices are either cash or debit/credit card (VISA/MasterCard) for orders via the App, the Site or via the Steers contact centre.

Real Rewards – Vouchers

  • All vouchers must be redeemed within the specified dates on the voucher.
  • Expired vouchers cannot be redeemed.
  • Vouchers cannot be exchanged for cash.
  • Steers is not responsible if a voucher is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.
  • Misuse constitutes fraud.
  • No change will be given on vouchers.

Reward Rules

Data bundles

  • Data bundles will deplete per 10kb
  • Data bundles cannot be used for data roaming
  • All non-qualifying data usage will be billed as per the customer’s price plan

Validity periods:

  • 1 day bundles: valid from time of redemption until 23:59 on the 1st day
  • Voice minutes bundles, SMS bundles and Data bundles Rewards will be allocated immediately to a Prepaid, Top Up or uChoose customer who has won one of these Rewards.
  • Contract customers will be allocated these Reward bundles within twenty four (24) hours of qualifying for the Reward.
  • Bundles will be available to use on the day of allocation, within any specified usage period, and will expire as per the stated validity period (e.g. DDMMYYYY HH:mm).
  • Unused Reward bundles will expire and there will be no carry over or refund.
  • Reward bundles cannot be transferred to other customers.
  • Any usage that falls outside the specified usage period or after the bundle is depleted will be billed at the customer’s applicable price plan rates.
  • Vodacom4Less customers will not receive discounts while they have an active TP voice bundle e.g. Bonus airtime or voice minutes
  • Data sessions initiated within the specified usage period but terminated outside of the period will deplete from the Data Reward bundle until the last minute of the stated bundle validity period and the remainder of the session will be billed from an existing active data bundle or at the specified out-of-bundle rate applicable to the customer’s price plan.
  • Prepaid, Top Up or uChoose customers converting to contract price plans or vice versa will not be able to retain their allocated voice minutes, Data or SMS Reward bundles once the conversion is successfully completed.
  • Prepaid customers converting to uChoose or vice versa will retain their allocated voice minutes, Data or SMS rewards bundles after the conversion is successfully completed.

General Terms and Conditions

  • All customers participating in this offer agree to be bound by these terms and conditions.
  • The decision of Steers and Vodacom in regard to all aspects of the promotion is final and no correspondence will be entered into.
  • Save in the event of Steers and Vodacom’s gross negligence, Steers and Vodacom, it’s directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage occurring as a result of participation in this game show or as a result of the use of any of the prizes, or from any amendments to these terms and conditions.
  • Steers and Vodacom shall have no liability whatsoever for any breach of these terms and conditions due to any cause beyond its reasonable control including but not limited to: an act of God (including inter alia weather, flood and lightning), technical issues (including inter alia network/technical operation interruption, telecommunication interruption, breakdowns, power failures and other interruptions), fire, industrial action, act or omission of Government, or other competent authority, riot, war or act or omission of any third party for whom Vodacom is not responsible.
  • If the promotion is held to be or becomes unlawful, Steers and Vodacom shall have the right to terminate this promotion immediately without prior notice. In such event the participants will waive all rights they may have had and acknowledge that they will have no right of recourse to Steers and Vodacom, its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors.
  • Steers and Vodacom may refuse to award any reward if any irregularities or fraudulent activities are suspected.
  • Steers and Vodacom, its directors, affiliates members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors will not be liable for taxes or any other cost incurred by the customer receiving a reward.
  • Steers and Vodacom shall be entitled, as far as is permissible in law, in their entire discretion, to reject any reward for any reason whatsoever and will not be obliged to correspond with any person about the promotion.

Collecting your personal information

  • The information we use will be your approximate location, based on the nearest mobile cell site. As a result, this will change as you move around with your mobile phone.
  • We will restaurant your information for as long as we have to by law. If there is no legal requirement, we will only restaurant it for as long as we need it.

Sharing your personal information

  • We may share information about you with:
    1. companies in the Vodacom and Vodafone Group (Vodafone Group Plc and any company or other organisation in which Vodacom owns more than 15% of the share capital);
    2. partners or agents involved in delivering the Services;
    3. companies who are engaged to perform Service for, on behalf of Vodacom (Pty) Ltd including Vodafone Limited, or the Vodafone Group;
    4. where applicable, credit reference, fraud prevention or business scoring agencies, or other credit scoring agencies;
    5. debt collection agencies or other debt recovery organisations;
    6. law enforcement agencies, regulatory organisations, courts or other public authorities if we have to, or are authorised to by law;
    7. emergency services (if you make an emergency call), including your approximate location.
  • We will release information if it’s reasonable for the purpose of protecting us against fraud, defending our rights or property, or to protect the interests of our customers.
  • If we are reorganised or sold to another organisation, we may transfer any personal information we hold about you to that organisation.
  • We may need to transfer your information to other group companies or service providers in countries outside South Africa. This may happen if our servers or suppliers and service providers are based outside South Africa, or if you use our services and products while visiting countries outside this area.
  • At your option, we may also share your information with partner organisations we’ve chosen carefully, so they can contact you about their products and services.

Keeping your personal information secure

  • We have specialised security teams who constantly review and improve our measures to protect your personal information from unauthorised access, accidental loss, disclosure or destruction.
  • If we have a contract with another organisation to provide us with services or a service on our behalf to process your personal information, we will make sure they have appropriate security measures and only process your information in the way we’ve authorised them to. These organisations will not be entitled to use your personal information for their own purposes. If necessary, our security teams will check them to make sure they meet the security requirements we have set.
  • Communications over the internet (such as emails) are not secure unless they have been encrypted. Your communications may go through a number of countries before being delivered – as this is the nature of the internet. We cannot accept responsibility for any unauthorised access or loss of personal information that’s beyond our control.
